Welcome to SnackFacts. These Terms of Service ("Terms") govern your use of the SnackFacts mobile application ("App") operated by SnackFacts ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

Acceptance of Terms

By accessing and using SnackFacts, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

SnackFacts is a snacks and caffeine intake tracking application designed to help users monitor their daily snacks and caffeine consumption. The App provides features including:

• Logging snacks and caffeine intake from various sources
• Tracking daily and weekly consumption patterns
• Providing personalized recommendations and alerts
• Syncing data across devices via iCloud

User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair the service
• Keep your device and App updated to the latest version

Intellectual Property Rights

The App and its original content, features, and functionality are and will remain the exclusive property of SnackFacts and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

User Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and SnackFacts, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms

Limitation of Liability

To the maximum extent permitted by applicable law, SnackFacts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Disclaimers

The App is provided on an "as is" and "as available" basis. SnackFacts makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information included in the App.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will stop immediately.

Updates and Changes

We reserve the right to:

• Update or modify the App at any time
• Change these Terms at any time by posting revised Terms
• Discontinue the App with reasonable notice

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
